Website terms of use
1. Who we are
The website at jivaconsultancy.co.uk (the “Site”) is operated by Jiva Consultancy (“we”, “us”). We are UK-headquartered and serve clients internationally.
2. Acceptance of these terms
By accessing or using the Site, you agree to these terms of use. If you do not agree, please do not use the Site. We may update these terms from time to time; the “Last updated” date will change and continued use after changes constitutes acceptance where permitted by law.
3. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. You must not:
- Attempt to gain unauthorised access to the Site, our systems, or third-party systems linked from the Site;
- Use the Site to transmit malware, scrape or harvest data at scale without permission, or overload our infrastructure;
- Misrepresent your identity or affiliation, or use the Site for fraudulent purposes;
- Copy, reproduce, or exploit Site content for commercial purposes except as allowed by law or with our prior written consent.
4. Intellectual property
Unless otherwise stated, we own or license the copyright, trade marks, and other intellectual property in the Site and its content (including text, layout, graphics, and logos). You may view and print pages for your internal business use; you may not modify, distribute, or create derivative works without our permission except as allowed by applicable law.
5. No professional advice; no reliance
The Site provides general information about our consultancy practice. It does not constitute legal, financial, tax, regulatory, food-safety, employment, or other professional advice. You must not rely on the Site as a substitute for advice tailored to your situation. Nothing on the Site creates a client relationship; an engagement exists only under an agreed written contract or engagement letter.
6. Third-party links
The Site may link to third-party websites or services (for example regulatory or industry resources). We do not control and are not responsible for their content, availability, or privacy practices. A link does not imply endorsement.
7. Disclaimer of warranties
The Site is provided “as is”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by applicable law, we exclude all liability for any loss or damage (whether direct, indirect, consequential, special, or exemplary) arising out of or in connection with your use of, or inability to use, the Site or any content on it, including loss of profits, data, or goodwill.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
If you are a consumer, you may have statutory rights that are not affected by these terms to the extent prohibited by law. If you are a business user, you accept that our total liability arising from the Site in any twelve-month period will not exceed one hundred pounds sterling (£100), except where the previous paragraph applies.
9. Indemnity
If you are a business user, you agree to indemnify us against reasonable losses, damages, and costs arising from your breach of these terms or misuse of the Site, except where caused by our negligence or wilful misconduct.
10. Availability and changes
We may suspend, withdraw, or change all or part of the Site without notice where reasonably necessary. We may also restrict access to some parts of the Site.
11. Privacy
Use of personal data in connection with the Site is described in our Privacy policy.
12. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle disputes arising from or connected with the Site, subject to mandatory protections for consumers or other persons that cannot be waived by contract.
